Terms of Service
Effective date: October 23, 2026
These Terms of Service govern your access to and use of investorcrate.com, our online store, and purchases, subscriptions, and promotions offered through them. They are intended to explain the rules that apply when you browse, place an order, enroll in a recurring subscription, or enter a sweepstakes. Please read them before using the Site. By using the Site or placing an order, you agree to these Terms and the policies incorporated below. If you do not agree, do not use the Site or place an order.
1. Who We Are; Agreement Scope
“Investor Crate,” “we,” “us,” and “our” mean Investor Crate, LLC, a U.S. limited liability company. Our current mailing address is 900 S. Willow Ave., Unit #2669, Cookeville, Tennessee 38501, USA. Contact us at support@investorcrate.com. These Terms apply to the Site, all products and services offered through it, and our communications about orders, subscriptions, or promotions. Separate product listings, checkout disclosures, subscription terms, refund terms, and Official Rules may add terms for a particular transaction or promotion. If they conflict with these Terms, the more specific disclosure or Official Rules control for that transaction or promotion, subject to applicable law.
The Site is operated on Shopify. Shopify provides e-commerce hosting and related services, and we use service providers such as Google, Meta, and Klaviyo for functions that may include analytics, advertising, customer communications, and marketing. Their services and our collection, use, and sharing of personal information are described in our Privacy Policy and any applicable state privacy notice.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering a binding contract to place an order, enroll in a subscription, or participate in a promotion, unless that promotion’s Official Rules impose a different lawful age requirement. You may not use the Site if applicable law prohibits you from doing so.
You agree to provide current, accurate, and complete account, billing, shipping, and contact information and to keep it updated. You are responsible for activity through your account and for protecting your login credentials. Tell us promptly if you suspect unauthorized access. We may suspend or close an account, cancel an order, or limit access where we reasonably believe information is inaccurate, activity is unauthorized, or these Terms or applicable law have been violated.
3. Products and Precious Metals
We sell physical goods that may include bullion, coins, rounds, bars, collectibles, and related products containing gold, silver, platinum, or other materials. Each listing and order confirmation describes the specific product, quantity, weight, metal content, condition, packaging, and other characteristics we represent for that item. Product images may be illustrative; where a listing identifies a specific design, year, mint, condition, or packaging as guaranteed, that specific description controls. We do not promise that a product will be identical to a photograph unless the listing says so.
Product availability, designs, years, mint marks, packaging, and shipment contents may vary as disclosed in the listing or subscription offer. We may correct listing errors, update descriptions, limit quantities, or discontinue products. If we cannot supply an item as ordered, we may cancel the affected order and refund amounts paid for that item, or contact you about an available substitute. We will not substitute a materially different product without your consent.
Prices for precious metals and collectible products can change. A product’s resale value, market price, premium, or desirability may rise or fall, and we do not guarantee future value, liquidity, profit, appreciation, or that you can resell an item for any particular amount. A retail price may include product, sourcing, handling, packaging, payment, and fulfillment costs and may differ from a quoted spot price or melt value. Unless a listing expressly states otherwise, we do not offer to buy back products, quote a guaranteed resale price, or maintain a market for them.
We sell physical merchandise. Our descriptions of bullion, coins, bars, or other items as collectibles or commodities explain the nature of the goods and are not a legal determination that a transaction is or is not an investment, security, commodity interest, or other regulated product under any particular law.
4. No Investment, Financial, Tax, or Legal Advice
Investor Crate is a retailer of physical merchandise. We are not acting as your investment adviser, investment company, broker, dealer, commodity trading advisor, fiduciary, financial planner, tax adviser, or legal adviser through the Site or a product sale. We do not manage, direct, or monitor customer portfolios, accounts, or investments and do not provide individualized recommendations about whether, when, or how much metal to buy, hold, or sell.
Product information, market references, educational content, and statements by our personnel are general information about merchandise and are not personalized advice or a prediction of performance. Any decision to purchase is yours. Consider the item’s total price, applicable premiums, the possibility of price changes, resale spreads, fees, taxes, storage, insurance, and your own circumstances. Consult an appropriately qualified independent professional for investment, financial, tax, or legal advice. Nothing in this section waives a right or remedy that cannot lawfully be waived.
5. Orders, Payment, and Sales Tax
An online order is an offer to purchase. We may accept it, decline it, or cancel it before shipment, including for inventory unavailability, a suspected payment or identity issue, suspected fraud or unlawful activity, a material listing or pricing error, an address restriction, or a legal or compliance requirement. An order confirmation acknowledges receipt and does not by itself mean that we accepted the order. Acceptance occurs when we send a shipment notice or otherwise expressly accept the order. If we cancel an order after payment, we will refund the amount charged for the canceled item or order to the original payment method, subject to applicable law.
You authorize us and our payment processor to charge the payment method you provide for the amounts shown at checkout, including applicable taxes, shipping, and other disclosed charges. You represent that you are authorized to use that payment method. If a charge is declined or reversed, we may pause fulfillment, request another payment method, or cancel the order. You remain responsible for amounts validly owed, but this does not limit rights you have under payment-card or consumer-protection laws.
You are responsible for applicable sales, use, excise, or similar taxes shown at checkout, except taxes based on our net income. Tax treatment may vary by jurisdiction and product. Tax estimates or collection do not constitute tax advice.
6. Shipping, Delivery, and Title
We currently sell and ship only to eligible U.S. destinations that our checkout accepts. We do not offer international sales or ship orders to foreign destinations. We also source merchandise through domestic wholesalers and suppliers. We may decline, cancel, or refund an order that requests shipment outside our supported U.S. destinations or that cannot be lawfully fulfilled.
Shipping dates or windows shown on a product page, at checkout, or in a subscription offer are estimates unless expressly stated as guaranteed. We will comply with applicable shipment-promise and delay-notice requirements. If we cannot ship within the promised time or the time required by law, we will provide any notice, choice, consent opportunity, or refund required by law. Carrier scans, weather, supply interruptions, address issues, security checks, and events beyond our reasonable control may affect delivery. We will assist with carrier claims and order issues as described in our Refund Policy.
Please provide a complete, secure, deliverable address and promptly correct errors. You are responsible for additional costs caused by an incorrect address, refused delivery, or failure to collect a package, to the extent permitted by law. We may require an adult signature or other delivery controls for certain orders. Title and risk of loss pass as provided by applicable law; nothing in these Terms shifts risk to you before the point allowed by law.
7. Subscription Products and Recurring Charges
A subscription is a recurring purchase of the merchandise and service described in the subscription offer. The offer, checkout page, and Subscription Policy disclose the price or pricing formula, billing frequency, renewal timing, shipment schedule, any service or shipping fee, cancellation method, and other material terms before you enroll. If a disclosed price or other material term changes, we will provide notice and obtain any consent required by law before charging you under the changed term.
By affirmatively enrolling and completing checkout, you authorize Investor Crate or the billing entity identified at checkout to charge the payment method on file for each renewal at the disclosed recurring price, plus applicable taxes and disclosed fees, until you cancel. The subscription will renew automatically unless canceled in accordance with the Subscription Policy. You may cancel through the online account or subscription-management method provided on the Site, or by contacting [SUPPORT EMAIL] / [SUPPORT PHONE]. Cancellation will stop future renewals; any order already processed or shipped, and any refund eligibility, will be handled under the Subscription Policy and Refund Policy and applicable law.
The Subscription Policy at https://investorcrate.com/pages/Subscription-Policy provides the operational details, including the applicable monthly cutoff, billing date, shipment timing, and when a cancellation takes effect. Review the terms displayed at enrollment, because schedules and offers may differ by subscription. If those details differ from a general description in these Terms, the offer-specific disclosures and Subscription Policy control, subject to law.
We may suspend or end a subscription if payment fails, the product is discontinued, we reasonably suspect fraud or abuse, or fulfillment becomes unlawful or impracticable. Where required, we will give notice and/or a refund. We will not treat a failed payment or silence as consent to a new or materially different subscription offer.
8. Refunds, Returns, and Order Issues
Our Refund Policy at https://investorcrate.com/pages/Refund-Policy explains eligibility, time limits, condition requirements, return instructions, shipping costs, and procedures for damaged, missing, incorrect, or lost orders. Please review that policy before purchasing. Nothing in that policy or these Terms limits a non-waivable right or remedy under applicable law. Any return or refund exception must be consistent with the Refund Policy and applicable law.
9. Sweepstakes and Other Promotions
We may offer sweepstakes, giveaways, contests, or other promotions. Each promotion is governed by its own Official Rules, which will identify the sponsor, eligibility and geographic limits, start and end dates, entry methods, free method of entry if applicable, entry limits, prize description and approximate retail value, odds or odds-determining factors, winner selection and notification, and other material conditions. The Official Rules for a promotion control over this section if they conflict.
Unless the applicable Official Rules expressly state otherwise and applicable law permits it, no purchase is necessary to enter or win, a purchase will not improve your odds of winning, and buying a product is not a substitute for following the free entry method. A promotion is void where prohibited and only open to the locations and individuals stated in its Official Rules. We may verify eligibility and entries and disqualify entries that are late, incomplete, automated, fraudulent, duplicate beyond stated limits, or otherwise violate the Official Rules. We will administer each promotion according to its Official Rules and applicable law.
The Giveaway Policy at https://investorcrate.com/pages/Giveaway-Policy contains general information. It does not replace the Official Rules for a specific promotion. Where a third-party platform hosts or administers a promotion, that platform is not the sponsor unless the Official Rules expressly say so. Promotions are not sponsored, endorsed, administered by, or associated with Meta, Instagram, Facebook, Google, Shopify, or any other platform unless the Official Rules expressly state otherwise.
10. Anti-Money Laundering, Sanctions, and Fraud Controls
We maintain an anti-money laundering compliance program and may use risk-based controls to protect our business, customers, suppliers, and the financial system. To verify identity, payment authorization, order legitimacy, shipping instructions, or compliance with applicable law, we may request information or documentation, review transaction patterns, screen orders, impose reasonable limits, delay fulfillment, decline or cancel an order, restrict a payment method, or suspend an account. We may be prohibited from explaining certain reviews, reports, or information requests.
You agree to provide truthful information and not to use the Site or any purchase to conceal the source, ownership, or destination of funds or property, evade sanctions, commit fraud, or violate anti-money laundering or other applicable laws. We may refuse a transaction or take other steps required or permitted by law. We do not promise to accept cash, third-party payments, anonymous purchases, or any particular payment method.
11. Acceptable Use and Intellectual Property
The Site, including its text, product descriptions, design, photographs, graphics, logos, software, and other content, is owned by or licensed to Investor Crate and protected by intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for personal, lawful shopping and account purposes. No ownership rights are transferred to you.
You may not copy, scrape, reproduce, publish, distribute, modify, reverse engineer, interfere with, or exploit the Site or its content except as allowed by law or with our written permission. You may not use bots or automated methods to access the Site, bypass security or purchase limits, transmit malware, interfere with other users, impersonate another person, submit false information, or use the Site for an unlawful purpose. We may suspend access and pursue lawful remedies for misuse.
12. User Submissions and Reviews
If you submit a review, photograph, comment, or other content to us or through a Site feature, you retain any rights you own in it. You grant Investor Crate a nonexclusive, worldwide, royalty-free license to host, reproduce, display, distribute, adapt for formatting, and use that content in connection with operating, improving, and promoting our business, subject to applicable law and our Privacy Policy. You represent that you have the rights needed to submit the content and grant this license.
Do not submit confidential, unlawful, infringing, deceptive, threatening, or abusive content, or content containing another person’s private information without authorization. We may remove or decline to display submissions, but we are not required to review every submission before it appears. Nothing here requires you to provide a review or prevents you from giving an honest opinion.
13. Third-Party Services, Links, and Tracking Technologies
The Site may contain or rely on third-party services, including Shopify, payment processors, shipping carriers, Google, Meta, and Klaviyo. These providers may process information under their own terms and privacy practices. We do not control third-party services and are not responsible for their independent acts or omissions. A third-party link is provided for convenience and does not mean that we endorse the linked service or its content.
The Site and third parties acting on our behalf may use cookies, pixels, tags, scripts, and similar technologies for Site operation, checkout, security, analytics, communications, and advertising, as described in our Privacy Policy and any applicable privacy notice or consent tool. Depending on your choices, location, browser, device, and applicable law, these technologies may collect or receive information about your device, visits, actions, or interactions and may support measurement or interest-based advertising. A browser setting or ad blocker may not prevent all collection or sharing. Consult the Privacy Policy and available privacy controls for choices and rights.
14. Privacy and State Privacy Notices
Our Privacy Policy at https://investorcrate.com/pages/Privacy-Policy describes the personal information we collect, how we use and disclose it, retention, security practices, cookies and advertising technologies, and how to contact us about privacy. The California and Texas Privacy Policy at https://investorcrate.com/pages/CA-and-TX-Privacy-Policy provides additional notices and rights for residents where applicable. These notices are incorporated by reference for their subject matter. If a privacy notice conflicts with these Terms about personal information, the privacy notice controls.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL ALWAYS BE COMPLETE, CURRENT, OR ACCURATE. PRODUCT-SPECIFIC express warranties, if any, are only those stated in the applicable listing or written warranty provided with the product.
Some jurisdictions do not permit particular warranty disclaimers, so some of the foregoing may not apply to you. Nothing in these Terms excludes a warranty or consumer right that applicable law does not allow us to exclude. For product and market-specific disclosures, see our Disclaimer at https://investorcrate.com/pages/Disclaimer.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVESTOR CRATE, LLC AND ITS OWNERS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITE, A PRODUCT, AN ORDER, A SUBSCRIPTION, OR A PROMOTION, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM ARISING OUT OF OR RELATING TO A PARTICULAR ORDER OR PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. FOR A CLAIM NOT TIED TO A PARTICULAR ORDER, OUR TOTAL LIABILITY WILL NOT EXCEED $100. These limits do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or any other liability that applicable law makes non-waivable. They do not limit a consumer’s right to a refund or other remedy required by law.
17. Indemnification
To the extent permitted by law, you agree to reimburse and hold harmless Investor Crate, LLC and its owners, employees, and agents from third-party claims, losses, and reasonable expenses arising from your material breach of these Terms, unlawful use of the Site, or infringement of another person’s rights. This obligation does not apply to the extent a claim was caused by our negligence, willful misconduct, or violation of law, and it does not require you to indemnify us for a claim where prohibited by law. We will give you notice of a claim when reasonably practicable and will not settle a claim in a way that imposes a non-monetary obligation on you without your consent.
18. Disputes, Arbitration, and Class Action Waiver
PLEASE READ THIS SECTION. IT AFFECTS HOW DISPUTES MAY BE RESOLVED. Before filing a formal claim, you and Investor Crate agree to try to resolve the dispute informally. The party raising the dispute must send a written notice describing the issue and requested relief to the other party. Notices to Investor Crate must be sent to 900 S. Willow Ave., Unit #2669 Cookeville, Tennessee 38501, United States and support@investorcrate.com. Each side will have 60 days after receipt to attempt resolution. This process does not prevent either party from seeking urgent temporary relief where necessary.
Except for a claim that may be brought in small claims court, a dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, as modified by this section and to the extent enforceable. The Federal Arbitration Act governs this arbitration agreement. The arbitration may be conducted remotely or, if an in-person hearing is required, in the county where you reside or another location required by the applicable rules or law. The arbitrator may award the same individual relief available in court. Investor Crate will pay arbitration fees to the extent required by applicable law or the consumer rules. Each party otherwise bears its own attorneys’ fees and costs unless the law or arbitrator permits a fee award.
YOU AND INVESTOR CRATE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, TO THE EXTENT THIS WAIVER IS ENFORCEABLE. The arbitrator may not combine claims or preside over a representative proceeding. If a court finally determines that this waiver is unenforceable for a particular claim or request for public injunctive relief, that claim or request will proceed in court and the remaining claims will proceed in arbitration to the extent permitted by law.
You may opt out of arbitration by sending us written notice within 30 days after your first acceptance of these Terms. The notice must include your name, mailing address, the email associated with your account or order, and a clear statement that you opt out of arbitration. Send it to 900 S. Willow Ave., Unit #2669 Cookeville, Tennessee 38501, United States and support@investorcrate.com. Opting out does not affect other parts of these Terms. If this arbitration section is held unenforceable, the dispute will be resolved in the state or federal courts located in Putnam, Tennessee, unless applicable law requires another forum. Nothing in this section limits rights that cannot lawfully be waived.
19. Governing Law and Venue
Tennessee law governs these Terms and any dispute concerning them, without regard to conflict-of-laws rules, except where federal law governs or applicable consumer-protection law requires the law of another jurisdiction. Subject to the arbitration section and any non-waivable venue rights, court proceedings must be brought in a state or federal court with jurisdiction in Putnam, Tennessee. You and Investor Crate consent to that court’s jurisdiction to the extent permitted by law.
20. Changes, Suspension, and Termination
We may update these Terms by posting a revised version on the Site and changing the effective date. Changes apply prospectively from the posted effective date, except where applicable law requires notice or consent. Material changes to an existing subscription will be handled under the subscription offer, Subscription Policy, and applicable law, and will not retroactively alter a completed purchase. Your continued use of the Site after updated Terms take effect means you accept the updated Terms for future use. If you do not agree, stop using the Site and cancel any subscription as provided in the Subscription Policy.
We may suspend or discontinue all or part of the Site or restrict access where reasonably necessary for maintenance, security, legal compliance, or prevention of fraud or abuse. Any accrued payment, refund, privacy, dispute-resolution, or other provisions that by their nature should continue will survive termination.
21. General Terms
These Terms, together with the policies and offer-specific terms they incorporate, form the entire agreement between you and Investor Crate concerning their subject matter and replace prior statements on that subject, except that they do not supersede a separate written agreement signed by both parties. If a provision is held invalid or unenforceable, it will be modified only to the minimum extent needed to make it enforceable, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, restructuring, or sale of business assets, subject to applicable law. These Terms do not create an agency, partnership, joint venture, employment, or fiduciary relationship. Headings are for convenience only.
22. Accessibility
We are working to make the Site accessible. If you need assistance accessing a product listing, checkout, subscription controls, or these Terms, contact us at support@investorcrate.com. Our Accessibility Policy is at https://investorcrate.com/pages/Accessibility.
